1. Alicia’s Photos (hereinafter referred to as “the photographer”) will provide photographic services to the client/s (hereinafter referred to as “the client”).
2. This Agreement expresses the full and complete agreement between the photographer and the client. It supersedes any prior agreement, written or verbal, between parties. This Agreement may only be altered in writing and as agreed by all parties.

Work product

1. The photographer will supply the client with a minimum of 20 – 100 images for the client to choose 3 – 20 images from. Depending on the Package that was chosen.
2. All images will be colour edited and the client will choose a final selection (depending on the package) to be further edited.
3. The Maximum turnaround time is within 2 weeks. I will send all original the photos to your email address.
4. Once you receive all the images, you then (depending on package) choose your final images for me to further edit, and then I will send those final images to you through email.
5. The final images will be sent email address within. Then the client will chose which image (depending on package chosen) will be made into an acrylic Photo Frame.
6. The final images will be stored on a high quality USB in a USB box, along with the acrylic photo frame (depending on package chosen) will then be posted to the clients address. Between 3 to 7 business days, depending on postage times.
7. The photographer, at their discretion, may provide “sneak peeks” (a small number of key images) to the client within this time frame. 

Fees

1. The photographer’s fee is to be paid as follows;
   1. A $49 non-refundable booking fee to be paid at the time of booking, and;
   2. The remaining balance (depending on package booked) is payable on or before the day of the photo session
   3. Alternatively, the photographer and client can agree to an alternative payment arrangement if provided so in writing by the photographer.
2. If full payment has not been made to the photographer in accordance with the above, and failing any alternative agreement, the photographer may not attend the session or may not begin editing photographs from the session. All photographs will be withheld until full payment is made.

Tardiness, cancellations and changes

1.  The client agrees to arrive at least 5-10 minutes prior to their scheduled session time. The session duration is between 30 minutes to 120 minutes (depending on booked session) and will not be extended if the client is late – this may impact the work product and/or quantity of images delivered to the client.
2. If the client misses their allotted session time, they will forfeit their session. The session fee will not be refunded.
3. In the event that the client is unable to attend the session, provided written notice is given to the photographer at least seven (7) days prior to the session, the client may transfer their booking fee to a new date and Package type that is mutually agreed upon by the client and photographer. The client may reschedule their session once without forfeiting their booking fee.
4. A second or subsequent request from the client to reschedule the session will see the client’s booking fee forfeited. The client will be required to pay an additional booking fee should they wish to secure a new session date.
5. If the client provides written notice to the photographer of their request to reschedule less than seven (7) days ahead of the session, their booking fee will be forfeited. The client will be required to pay an additional booking fee should they wish to secure a new session date.
6. In the event that the client seeks to cancel their session, provided at least seven (7) days written notice is given to the photographer, the photographer will refund the booking fee only if the photographer is able to secure a new booking for that mini session time slot.
7. If the client provides less than seven (7) days written notice to the photographer of their request to cancel, their booking fee will be forfeited.
8. In the event that the photographer needs to reschedule the session, the client will be informed in writing at the earliest opportunity for reasons including, but not limited to, sickness or inclement weather. The client’s booking fee will be transferred to a new date that is mutually agreed upon by the client and photographer. Alternatively, the photographer may offer a suitable replacement photographer for the session. If the session is unable to be rescheduled and a suitable replacement photographer is unable to be offered, the photographer will refund the booking fee.

Retention of images

1. The client will be given a High Quality USB with all images.
2. Upon delivery of files to the client, the client will have sole responsibility to protect and retain the USB and images for future. It is highly recommended that all files on the USB be saved and stored in a safe place with a duplicate copy created and kept in a separate location if possible.
3. The client can request replacement digital copies from the photographer up to one (1) year from the original delivery date. After this time, the photographer retains the right to refuse replacement of digital or USB copies of images.

Limit of liability

1.  The photographer is not responsible for any injuries incurred or inflicted upon participating parties nor any damage to public or private property during the session. The client is responsible for any children or adults at the session and releases the photographer from any claims against the photographer’s person or business. The photographer is limited to a full refund of any monies paid by the client, which shall be in full and final satisfaction to any damage or loss suffered.
2. The photographer is not responsible for failure or delay in providing the service contracted herein due to any events beyond her reasonable control, including but not limited to acts of God or elements of nature (including fire, flood, earthquake, storm or other inclement weather), war, civil commotion, labour disputes, strikes, health pandemics, government regulation or restriction.
3. The photographer takes great care with respect to exposure, storage, and processing photographs/images, but cannot and does not guarantee that photographs/images of the session will not be lost, stolen or destroyed for reasons within or beyond her control. The client agrees that the photographer’s full and complete responsibility and liability is limited to the return of all payments received for the session. 

Copyright, reproduction and model release

1. The copyright of the photographs is retained at all times by the photographer.
2. Under no circumstances will alterations be made to the photographs as provided by the photographer.
3. All digital photographs provided by the photographer to the client will include a print release, allowing the client to print the photographs or post the photographs online for personal use only.
4. The photographer must expressly approve any commercial use of the photographs in writing and any such use of the photographer’s work must include citation. This includes online and print publications, social media and other purposes.
5. The client grants the photographer and any successors, heirs, executors administrators, assigns, attorneys, representatives and agents, the irrevocable and unrestricted right to use and publish photographs of the client or in which the client may be included, for editorial, trade, advertising or any other purpose and in any manner or medium; to alter the same without restriction; and to copyright the same. The client hereby releases the photographer and abovementioned agents from any and all claims, actions, demands, suits, liabilities, damages, expenses, and obligations of any kind arising from, or related in any manner to the photographer’s use of said images.

Social media

1. Under no circumstances will the client alter the photographer’s photographs that are shared in the public domain, including but not limited to Facebook, Instagram and blogs. Alterations include, but are not limited to, changes in colour and cropping (with the exception of forced cropping on social media platforms).
2. The client is responsible for any family member or friend sharing the photographer’s work and agrees that the photographs will not be cropped, altered in colour or edited in any way (with the exception of forced cropping on social media platforms).
3. When publishing the photographer’s work online or otherwise, the client (and/or their family members or friends) will provide a citation to the photographer.

Cooperation and accuracy

1. The photographer is under no obligation to capture any specific moments or poses during the photo shoot. The photographer will endeavor to capture a range of images to present to the client and the images delivered by the photographer will be of a similar style and caliber to the photographer’s previous works as portrayed on the photographer’s social media and website.
2. The photographer will retain complete creative control of the photographs and post-processing. The images will be delivered in JPEG format with a mix of colour as deemed appropriate by the photographer. No re-editing will be carried out after the photographer delivers final edited images to the client.
3. The photographer is not responsible for limited coverage or quality due to circumstances beyond their control, including but not limited to; weather, location obstructions, time restraints if the client is late for the session, a subject’s ability to cooperate and interference from members of the group or public. No re-shoots or refunds will be given should any of these occurrences arise.
4. The photographer will not edit physical size nor any other physical aspect or appearance issue other than minor blemishes. At her discretion, the photographer will re-touch a handful of key photos where necessary (e.g. remove a background distraction or acne spot).

Acceptance of these terms

1. By signing the Service Agreement between the photographer and the client, the parties of the agreement are bound by these terms and conditions.
